The flaw in non-lawyer debt relief programs.
Consumers need to be very wary whenever a non-lawyer Debt Negotiation Program advises you to stop making payments on your credit cards, and, instead, to pay money into an escrow account - a portion of which goes to them - until you can build up a large enough balance to make settlement offers on your debt.
The central flaw in this approach is this: After you have stopped making your monthly payments, you will almost certainly be sued. When this happens, your non-lawyer debt negotiator loses leverage. While non-lawyers may continue to negotiate for you, they cannot defend you in the lawsuit. Plaintiffs' lawyers know this, and will drive a harder bargain than they might if you were represented by an attorney who could defend you aggressively in court. Many non-lawyer debt negotiators will withdraw totally when a lawsuit is filed.
Unfortunately, many of our clients have learned this lesson the hard way and have paid debt negotiation companies significant sums for nothing.
